Welcome to ‘Jane & Tash’ website Terms and Conditions. By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions along with our Privacy policy.
Before placing your order, if you are unsure about anything relating to these Terms and Conditions please do not hesitate to get in touch at sales@janeandtash.co.uk. May we remind you that once an order is placed we will not be able to make any changes to that order.

Our office hours are 9am - 5pm, Monday to Friday. We aim to respond to all email enquiries within 48 hours (excluding weekends and UK Public Holidays). Orders placed on weekends for in stock items will be sent out on the next working day. 

Appendix A for materials of garments can be found at the bottom of this page.

Brexit Update

Please note that following Brexit, customers ordering from European Union Countries will be required to pay VAT and import duty taxes upon delivery.  As the recipient of the order, you must pay these duties and taxes directly to the courier to release your order from customs. As we are unable to advise the exact amount, we recommend contacting your local customs office or tax authority before placing an order. 

We are adapting to the information provided as best as possible, however no exact amounts have yet been published regarding the breakdown of import charges.  

 

Changes to Terms and Conditions

These terms and conditions may be subject to change and alterations periodically. Once any changes to these terms and conditions are posted, these will apply to all orders received. Subsequently these changes will also apply to your use of the ‘Jane & Tash’ website and constitutes your agreement to and acceptance of such changes.


Privacy Policy
Our privacy policy displays how we will use your information. By using the site you consent to our privacy policy and ensure that any data you provide to us is accurate.

 

Governing law and Jurisdiction

Our terms and conditions are in accordance with the laws of England and all disputes will be settled in the English court system.

 

 

1. Information

1.1. When placing an order we will ask for your name, telephone number, billing address, delivery address and payment method details. 

1.2. This data will enable us to fulfil our order as efficiently as possible and also keep you up to date with ‘Jane & Tash’ news, new product lines, events etc. if you so wish. 

1.3. Your information may also aid us in preventing and detecting fraudulent requests for goods and services.

1.4. If any incorrect details appear such as mismatching shipping and billing, mismatching IP address, mismatching names, countries or even cities then we may require additional data upon receiving your order if any details are flagged as potentially fraudulent. We will only use the requested data from you to confirm that the card's registered billing address matches the name as shown on our order and it is being used by the card holder only - this will stop any potential chargebacks being issued.

1.5. If we suspect any suspicious transactions relating to an order, we have the right to cancel an order at any time. 

 

2. Terms of Sale

2.1.  By placing an order through our website you are adhering to the current terms and conditions of ‘Jane & Tash’ displayed on their website.

2.2. When placing an order on the website you must represent that all the details you provide must be correct and true. These include that you are the owner of the payment card used and have sufficient funds to cover the cost of purchase and delivery charges.

2.3 We kindly request to please allow 1 working day for us to process your order. All our products are made to order once we have received an order. Once an order has been confirmed and processed, production will take approximately 7-10 working days for Made To Order Item and Non-Bespoke items. For Pre-Order Items delivery times vary and please check the online product pages for delivery times. Please note this does not include weekends or bank holidays. Once production of your order is complete and it's ready for dispatch, you will receive a confirmation email along with tracking details.

2.4 Please note we do hold some ready to buy items that can be shipped immediately, subject to stock availability. Product pages are normally listing in stock sizes for 2-3 working day delivery. Please email us at sales@janeandtash.co.uk to enquire further. Please note that if you need your order by a specific date we will do our utmost to ensure you receive your item in time. 

2.5  When you place an order you will receive an email confirmation that your order has been received. The confirmation email that your order has been completed and accepted will be sent separately to you once your order has been dispatched.

2.6 Please note that once an item has been dispatched Jane & Tash are not responsible for any lost parcels or items that have not been disclosed within 72 hours of delivery. All parcel enquiries should be raised with the Courier Service which are responsible for the delivery of items. If a customer notifies Jane & Tash of a lost or damaged parcel outside this 72 hour period, we reserve the right to refuse a refund and/or exchange.

2.7 Jane & Tash reserve the right to cancel & not proceed with any order at their own discretion.

2.8 Retrospectively discount codes can not be applied once an order has already been placed.

 

3. Prices

3.1.  All product prices are exclusive of delivery charges.

3.2. Prices on this website are subject to change without notice however placed orders will remain unaffected.

3.3 Prices on our website are inclusive of UK VAT. We are not responsible for import duties incurred if you are based outside of the UK. Import duties are payable by the receiver of the parcel as they are importing a product from the UK to their own country.

 

4. Payment

4.1.  All orders placed on the website must be paid with a debit or credit card that is coherent with our payment options. The payment types we accept are PayPal and PayPal approved cards.

4.2. When the order is received, a pre-authorisation check will be carried out on the card to ensure there are sufficient funds to make the purchase. 

4.3. For International payments, all customers are responsible for the payment of duties and taxes for shipments. 

 

  

6. Force Majeure

6.1. ‘Jane & Tash’ shall not be liable for any delay of order due to the results of any events/circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, and accidents.

 

 

7. Returns/Exchanges

7.1 To be eligible for a return/exchange your item must be unused and unworn and in the same condition that you received it with all tags still attached and returned by guaranteed delivery to Jane & Tash Bespoke within 14 days of confirmed delivery of your item. Your item must be returned in its original packaging and original condition to be eligible for a full refund. Please note exchanges are not currently available for countries outside the UK. Jane and Tash cover the cost of postage shipped back out to UK orders eligible for an exchange (This does not apply to international customers).

7.2 For returns, please request a return authorisation request from our returns department within 14 days of receiving your order by emailing us at sales@janeandtash.co.uk. Please do not send your item back to us after the returns period. Returns made outside the return period will be sent back to you and a handling charge will be processed. For International returns please ensure you classify your parcel as a 'return' and this will allow us to process your parcel back into the UK swiftly. *Failure to do so will result in additional charges which will be deducted from your refund. 

7.3 Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item. If your return is approved we will initiate a refund to you immediately. Please allow up to 7-10 working days for your funds to reach your account as this is processed by your Bank. 

7.4 All returned items are the customer's responsibility and must be packed properly and securely to avoid any damages. If an item is returned to us damaged, worn or in an unsuitable condition, we will not be able to provide a refund and we will send the item(s) back to you. We also reserve the right to ask the customer to cover the re-delivery costs. 

7.5 You will be responsible for paying your own shipping costs for returning your item (with the exception of certain circumstances that are agreed with Jane & Tash Bespoke). All returned items must be sent back via recorded special guaranteed delivery to ensure we have updated tracking of the returned item. Jane & Tash Bespoke are not responsible for any items/parcels that cannot be found if the customer has failed to provide the relevant tracking information. Once an item is returned please notify us via email with  your tracking number so we can ensure your item is on its way.

7.6 The cost of returning the items are non-refundable and are paid by the customer.

7.8 On Bespoke (including bridal/beaded/embroidered/custom length sleeves/custom colours) items Jane & Tash cannot accept Returns. Please double check our Size Chart carefully before placing an order.

7.9 Bespoke products can take up to 6 weeks to make and be delivered to the recipient.

7.9.1 All Bespoke items are 100% non-refundable and non-exchangeable.

7.9.2 For Bespoke size items, following the 3 days after the order has been placed there is a non-cancellation policy as this is a Made to order/Bespoke item that will already be in production.

 

 

8. Faulty Items

8.1 All garments are quality checked thoroughly when packaged for any faults before shipping. We cannot risk any faults as each order is of high value. All orders claimed at being faulty will be examined very carefully as we do not send out faulty items. 

8.2 If you consider your Jane & Tash item to be faulty, please email us at sales@janeandtash.co.uk within 7 days of your purchase. We are then only obliged to repair, replace or refund the item within a 6 month period. 

8.3 If your item is found to be faulty, we can exchange and/or replace your item. Alternatively, a credit note or refund may be issued if a fault has been found, upon examination.

8.4 We reserve the right to refuse refunds or exchanges on faulty items that have been worn, used and are not in their original condition. Please note that normal 'wear and tear' of a product or a 'sample sale' item is not deemed to be faulty under any circumstances. 

 

 

9. Discount codes & Offers

9.1 For any returns using our discount codes, if there is a complimentary gift this must also be returned in its original packaging and unused. Any unwanted items must be returned within 14 days from the date they have been received to qualify for a refund or an exchange.

9.2 Discount codes are limited to one code per customer only. Discount codes cannot be used in conjunction with any other offer or discount code and are valid for the dates specified by Jane & Tash Bespoke only. 

9.3 Discount codes exclude Sale, Sample Sale, Bespoke & Bridal Collections and your order may be cancelled if a code is used on excluded products.

9.4 Discount codes can only be used on the dates specified and will not be extended or applied to orders that have been purchased on dates that fall outside this period.

9.5 Discounts cannot be given retrospectively 

 

 

10. Bespoke items

10.1 Bespoke items include and are not limited to; bridal jackets, coats, embellishment, parkas that are ordered with a specific sleeve length (e.g. 2 inches shorter/longer), embroidery, embellishment, custom colour combinations etc. If you are unsure if your item falls under the ‘Bespoke’ category, please contact us before placing an order. 

10.2 Given the exclusivity of Bespoke items, we do not offer returns or refunds. ‍Please do feel free to contact us to advise on colours, sizing and fabrics at sales@janeandtash.co.uk prior to placing your order. We aim to ensure absolute satisfaction.

 

 

11. Sale Items 

11.1 No Returns/Refunds/Exchanges on any purchases under 'Sample Sale' collection. All sales and prices are final.

11.2 Discount codes and offers are not applicable to Sample Sale items. We cannot process any Sample sale or Sale purchases with a discount code.

11.3 Sample Sale items may have a slight defect or imperfection i.e. due to wear from a model on a photoshoot but these are not deemed or classed as faulty. By purchasing a Sample Sale item, the customer agrees and accepts the above terms of sale. 

 

 

12. International Delivery & International Returns 

12.1 All International orders are delivered by FedEx and/or DHL and will be delivered approximately 3-4 working days after the dispatch date. Delivery includes tracking details and requires a signature upon arrival. For some countries, delivery times vary so please email us for more information on this. 

12.2 All international customers are responsible for paying any customs or import tax due upon the package arriving in their country. For International orders including Returns/Refunds/Exchanges, Jane & Tash Bespoke are not liable to pay returns custom duties and taxes. These fees are the sole responsibility of the customer and are to be paid by the customer. Returns must be in accordance with our returns policy as defined under subject line 7.0 Returns.

In the event of refusing to pay import duty tax due on your parcel, the courier reserves the right to dispose of your parcel and therefore your order will not be eligible for a refund. 

12.3 Please note Jane & Tash Bespoke are not responsible for delays due to customs clearance as this is beyond our control. Orders do not include possible taxes and duties which may be applied by customs authorities on delivery into your country.

12.4 Import Duties and Taxes are the responsibility of the customer, should the brand be charged any customs/duties on return of an item this will deducted from the final refund. If you fail to comply with customs and consequently the parcel is returned to Jane & Tash Bespoke, you will be liable for the additional fees charged for return and re-delivery.

12.5 For further information on what duties and taxes may be payable by you prior to the delivery/return of your parcel, we strongly recommend checking your local customs website or contacting them directly prior to placing your order.

12.6 European Union Countries: Please note that following Brexit, customers ordering from European Union Countries will be required to pay VAT and import duty taxes.

For further information we do recommend contacting your local customs office directly as this is beyond our control. 

As the recipient of the order, you must pay these duties and taxes directly to the courier to release your order from customs. As we are unable to advise the exact amount, we recommend contacting your local customs office or tax authority before placing an order. 

 12.7 If a package is rejected due to fees not being paid and the package is returned to us with fees to pay, this returns charge will deducted from the refund amount along with the original shipping cost. 

 

13. Lost Parcels

Jane & Tash Bespoke Ltd are not responsible for lost or missing parcels, or if a package is showing as delivered. It is the customers responsibility to follow their parcel's journey using the tracking information provided. In the event that a parcel is returned back to us, original shipping costs will be deducted and reshipping costs will apply.
